What the 2018 Farm Bill Actually Says
The 2018 Agriculture Improvement Act legalized hemp and hemp-derived products containing less than 0.3% THC by dry weight. This made CBD from hemp federally legal — but with important caveats around FDA oversight of food, beverages, and supplements.
The FDA has not approved CBD as a dietary supplement or food additive. Companies can sell CBD topicals and oils, but adding CBD to food or drinks for sale across state lines remains technically illegal without FDA approval.
